These Terms of Service (the “Agreement”) govern your access to and use of the website www.bytevending.com and any affiliated pages or content offered by Byte Vending, LLC (“Byte Vending,” “we,” “us,” or “our”) (collectively, the “Site”). By accessing or using any part of the Site or related services, you agree to be bound by this Agreement and all policies referenced herein (including our Privacy Policy). If you do not agree with these terms, please do not use the Site.
1. Eligibility

2. Account & Site Access
If you create an account, register your property, or interact with any Site feature, you are responsible for maintaining the confidentiality of your login credentials. All activity under your account is your responsibility. Notify us immediately of unauthorized use. Byte Vending is not liable for losses arising from unauthorized access to your account.
3. User Content & Contributions
From time to time, you may submit content (e.g., feedback, testimonials, support messages). You affirm that your submissions:
Do not violate any third-party rights
Are not harmful, illegal, or spam
Do not contain viruses or malware
By submitting content, you grant Byte Vending a non-exclusive, royalty-free license to use, display, and promote that content. Byte Vending reserves the right (but is not obligated) to remove any content in violation of this policy.
4. Services & Payment Terms
Byte Vending delivers smart vending services, machine placement, inventory management, and related business support. If you sign up for services involving recurring fees:
You agree to pay setup fees and monthly or annual charges as communicated.
Payments are non-refundable unless otherwise agreed.
Subscriptions auto-renew unless canceled in writing at least 30 days prior to renewal.
We reserve the right to modify service offerings or fees with 30 days’ notice. If you terminate prematurely, previously collected fees typically remain non-refundable.
5. Support
Our support channels vary by client arrangement. We offer standard email support, with expedited priority support for full-service contracts. Response time is generally within one business day, per our internal support policy.
6. Website & Third‑Party Content
Byte Vending is not liable for content accessed via external links. We do not endorse or guarantee third-party websites’ accuracy or statements. Use discretion and take appropriate precautions when visiting such links.
7. Intellectual Property
All content on the Site, including logos, trademarks, and text, are the property of Byte Vending or its licensors. Your use of the Site does not transfer any rights to Byte Vending intellectual property.
8. Disclaimer of Warranties
The Site and its services are provided “as-is.” Byte Vending disclaims all implied warranties, including merchantability or fitness for a particular purpose. We do not guarantee uninterrupted or error-free performance.
9. Limitation of Liability
Byte Vending—and its affiliates—will not be liable for:
Indirect, incidental, or consequential damages
Losses due to service interruption or data issues
Amounts beyond fees paid by you in the previous 12 months
This limit applies to all legal theories unless prohibited by applicable law.
10. Indemnification
You agree to indemnify and hold Byte Vending and its directors, employees, and agents harmless from claims, liabilities, damages, or expenses (including attorneys’ fees) arising from your use of the Site or breach of this Agreement.
11. Changes & Termination
We may modify this Agreement at our discretion—you are responsible for reviewing updates. Continued use of the Site constitutes acceptance of changes. Byte Vending may terminate your access at any time for breach or at its discretion. Surviving sections include IP, limitation of liability, and indemnity.
12. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Florida, excluding its conflicts provisions. Any disputes shall be resolved in Florida courts. Claims for injunctions or intellectual property may be pursued without bond. Other disputes may be subject to arbitration in Florida under JAMS rules, with each party bearing its own attorneys’ fees, except the prevailing party may recover costs.
By using this Site, you acknowledge that you have read, understood, and agree to these Terms of Service.
